The Bill of Rights set forth the civil rights enjoyed by our citizens. A civil right is an enforceable right or privilege, which if interfered with by another, gives rise to an action for injury. For example, the First Amendment to the United States Constitution protects the right to freedom of religion, freedom of speech, freedom of the press, and the freedom of assembly. The Fifth Amendment protects against double jeopardy and the right against self-incrimination. The Sixth Amendment guarantees the right to a counsel, the right to confrontation, and speedy trial. The Eighth Amendment protects against cruel and unusual punishment. Police abuse cases often involve unlawful conduct under the Fourth Amendment that protects all persons from unreasonable searches and seizures. This means that the police may not arrest someone without probable cause, and may not use unreasonable or excessive force in effecting a lawful arrest. Most claims of police abuse involve false arrest and police brutality involving the use of excessive force. All too often, persons who are unlawfully assaulted by the police, find themselves falsely accused of crimes ranging from disorderly conduct and resisting arrest to aggravated assault on the police officer.
